Oral Agreement Has Legal Force: Lottery Winner Ordered to Pay Colleague 10% of Winnings

A resident of the Spanish town of Tomiño has been ordered by a court to pay €100,000 to a colleague after winning €1 million in the Rasca Mega Millonario scratch-card lottery, La Razón reported.
Rasca Mega Millonario offers a top prize of €1 million. On July 31, 2022, the two men each purchased a ticket costing €10.
According to the report, the colleagues had reached a prior verbal agreement that if either won the top prize, he would give the other 10% of the winnings — €100,000.
The tickets were bought separately, meaning the prize formally belonged to the individual holding the winning ticket.
After the win, the men celebrated together. However, the winner later refused to honour the agreement, saying his daughter opposed sharing the money. The colleague subsequently filed a civil lawsuit.
A court in the city of Tui ruled that the oral agreement was legally binding, finding that its existence had been proven. The decision was based in part on witness testimony confirming that the arrangement had been made.
Court materials also included a recording of a telephone conversation in which the winner effectively acknowledged the prior agreement while explaining his refusal to comply. The court upheld the claim in full, ordering the defendant to pay €100,000 plus interest for late performance of the obligation.
