A federal class action lawsuit has been filed in the United States against casino and resort operator Wynn Resorts, Gambling Insider reported, following claims by the hacking group ShinyHunters of a large-scale data breach.
The complaint was filed on Feb. 21 in the U.S. District Court for the District of Nevada. The plaintiff, Richard Reed, brought the action on his own behalf and on behalf of others whose data may have been compromised, according to the filing.
The lawsuit alleges that the company failed to implement adequate safeguards to protect personal information, resulting in the exposure of data belonging to more than 800,000 individuals.
Nature of the Claims
Court documents state that the incident may have exposed customers’ personal data, including Social Security numbers (SSNs), names, contact details and other information that could be used for identity theft.
The plaintiff argues that Wynn Resorts did not take sufficient measures to secure the data, failed to encrypt sensitive information and did not fully disclose the circumstances of the incident in its notification to affected individuals. The lawsuit also contends that the company’s offer of 24 months of free credit monitoring is inadequate, as the risk of identity theft may persist beyond that period.
The plaintiff is seeking class certification, damages and an order requiring the company to address the alleged deficiencies.
Discrepancies Over the Scope of the Breach
The data referenced in the lawsuit differs from information previously cited by the hacking group. Media reports, quoting ShinyHunters, had indicated that employee data at Wynn Resorts may have been compromised, including names, contact details, job titles, salaries and Social Security numbers.
Gambling Park notes that Wynn Resorts has not publicly confirmed a breach or specified which categories of data may have been affected. As a result, the precise nature of the compromised information remains unclear.
