Court Dismisses Lawsuit Against DraftKings: Bonus Doesn’t Mislead Reasonable Consumers

A U.S. court has dismissed a class-action lawsuit against the sportsbook DraftKings, which was accused of misleading customers about the terms of a bonus promotion, according to Next.io.
Under the promotion’s terms, customers needed to deposit $5,000 and wager a total of $25,000 within 90 days to receive a $1,000 bonus.
Nerye Aminov, the initiator of the class-action suit, alleged that DraftKings failed to clearly communicate these conditions.
Aminov himself deposited only $500 and received a bonus of just $100, despite expecting the full $1,000. It appears he may not have carefully reviewed the promotion’s conditions.
In reviewing the case, the court found that the promotional terms were clearly stated, not hidden, and displayed in a readable font. The rules were readily accessible and could have easily been understood by customers willing to review them.
Moreover, the court ruled that DraftKings’ promotional language, including phrases such as “up to $1,000,” was unlikely to mislead a reasonable consumer.
As a result, the court not only sided with DraftKings but also questioned the validity of the claims presented by other participants in the class-action lawsuit.
